DOT Clearinghouse

Beginning January 2020, the Clearinghouse is an established online database that gives employers, FMCSA, state driver licensing agencies, and state law enforcement personal an extra tool to use to keep our roads safe. Using real-time data collection, all commercial driver’s license (CDL) and commercial learner’s permit (CLP) holders’ drug and alcohol program violations will be recorded in this system.

The Clearinghouse database will nationally improve safety on our roadways by giving employers access to information they need to make informed safety decisions about which employees to place in safety-sensitive jobs, including operating a commercial motor vehicle (CMV).

 

What Types of Drivers and Employers Use the Clearinghouse Affect?

In short, all CDL drivers who operate commercial motor vehicles on public roads, their employers, and service agents will be affected by this change. The system is designed to let employers report drug and alcohol violations and check that no current or potential employee is prohibited from performing their safety-sensitive job. Current CDL drivers can view their own records, approve the use of personal records to potential employers, as well as have access to valuable substance abuse resources. Medical review officers, substance abuse professionals, state driver licensing agencies, and some third-party administrators will have access to reporting drug test results and perform queries as required.

Some examples of drivers affected by the Clearinghouse database include, but are not limited to:

  • Interstate/intrastate motor carriers (including passenger carriers)
  • School bus drivers
  • Construction equipment operators
  • Limousine drivers
  • Federal and other organizations that employ drivers subject to FMCSA drug and alcohol use testing regulations

What Information Does the Clearinghouse Collect?

The Clearinghouse database contains records of violations of drug and alcohol prohibitions including positive drug or alcohol test results and test refusals. When a driver completes the return-to-duty process and follow-up testing plan, this information will also be recorded in the Clearinghouse database for national use.

Some of the violations reported to The Clearinghouse includes, but is not limited to:

  • Test positive for use of specified drugs completed in our lab
  • Refusing to submit to a required alcohol or drug test
  • Alcohol use while performing, or within four hours of performing, a safety-sensitive function
  • Report for duty/remain on duty for safety-sensitive function with an alcohol concentration of 0.0 or greater or while using any drug specified with your job’s regulations (other than those prescribed by a medical professional)
  • Alcohol use within eight hours of an accident, or until the post-accident test, whichever occurs first
