DOT Alcohol Testing Requirements Knoxville Employers Need to Know
The Evidential Breath Testing (EBT) device used in DOT Alcohol Testing must be approved by the National Highway Traffic Safety Administration and can only be operated by a certified breath alcohol technician. The process runs in two steps: an initial screening, followed by a confirmation test if the screening result comes back at 0.02 blood alcohol content or higher.
A confirmed result between 0.02 and 0.039 requires the employee to be removed from safety-sensitive duty for a minimum of 24 hours. A confirmed result of 0.04 or higher is a federal violation requiring immediate removal from safety-sensitive functions.
Several situations constitute an automatic failed test under DOT rules:
- Refusal to take the breath alcohol test
- Refusal to complete or sign the Breath Alcohol Testing form
- Refusal to provide adequate breath
- A confirmed result of 0.04 blood alcohol content or higher
- Refusal to cooperate with any part of the testing process
When DOT Alcohol Testing Is Required
Post-Accident Testing
After a qualifying accident involving a covered employee, DOT requires an alcohol test to be administered as quickly as possible, generally within two hours and no later than eight hours after the incident.
Reasonable Suspicion Testing
When a trained supervisor observes behavior or appearance suggesting alcohol misuse, a test is required. The supervisor must document their observations in writing.
Return-to-Duty & Follow-Up Testing
Any employee returning to safety-sensitive duties after a DOT alcohol violation must pass a return-to-duty test first. Follow-up testing then continues for a period determined by a Substance Abuse Professional.
Random Testing
FMCSA currently requires that employers test 10% of covered employees for alcohol each year through a scientifically valid random selection process. Employees must be tested immediately upon notification.
Pre-employment alcohol testing is optional under FMCSA rules, but if an employer chooses to test, every candidate must be tested without exception.
