Which Employers Must Conduct DOT Random Testing

Federal regulations require employers under six safety-sensitive agencies to maintain a random drug and alcohol testing program for covered employees. Those agencies are the Federal Motor Carrier Safety Administration (FMCSA), Federal Aviation Administration (FAA), Federal Railroad Administration (FRA), Pipeline and Hazardous Materials Safety Administration (PHMSA), Federal Transit Administration (FTA), and United States Coast Guard (USCG). Under 49 CFR Part 40, safety-sensitive employees must be enrolled in a DOT-approved random testing pool.

How the DOT Random Testing Process Works

Random testing must use a scientifically valid selection method so that every covered employee has an equal, impartial chance of being chosen each cycle. Employers can’t manually select who is tested. Once selected, the employee reports for a urine collection conducted under strict chain-of-custody procedures by a certified collector.

Approved alcohol testing methods include breath alcohol testing and saliva-based screening. Breath alcohol tests can deliver results immediately, while laboratory-based urine drug test results are typically available within 24 to 48 hours. All DOT urine results go through a licensed Medical Review Officer (MRO) before reaching the employer so the review can account for any legitimate medical explanation.

After a Positive Result

An employee who tests positive during a DOT random drug test must be immediately removed from safety-sensitive duties and can’t return until completing the DOT return-to-duty process, which includes evaluation by a Substance Abuse Professional (SAP) and a negative return-to-duty test.

For CDL holders, a positive result is recorded in the FMCSA Drug and Alcohol Clearinghouse, a federal database that both current and prospective employers are required to query. This makes accurate recordkeeping critical from the moment of collection.

Annual Reporting Requirements

DOT agencies require employers to file Annual Management Information System (MIS) reports summarizing their testing data for the year. Incomplete or missing records can draw the same regulatory scrutiny as a missed test, so maintaining thorough documentation throughout the program cycle is essential.
