Not every accident triggers a federal testing obligation, but three specific scenarios apply under 49 CFR 382.303. Knowing them before an incident helps keep your fleet compliant when it counts.
- Fatality: Any accident involving a human fatality requires post-accident testing, regardless of whether a citation was issued.
- Injury requiring off-scene medical treatment: If the CDL driver received a citation for a moving violation and someone required immediate medical treatment away from the scene, testing is required.
