Federal regulations define exactly when a DOT drug or alcohol test is required. Understanding each occasion helps employers act correctly and on time.

Pre-employment: Required before a safety-sensitive employee begins regulated work. The employee can’t perform safety-sensitive functions until a negative result is received.
Random: Employers must use a scientifically valid random selection method. DOT agencies set annual minimum testing rates, and tests must be unannounced and spread throughout the year.
For-cause/reasonable suspicion: A trained supervisor initiates testing based on documented observations of appearance, behavior, speech, or smell. Supervisor training is required to make this call.
Post-accident: Required when a fatality occurs or when certain injury or vehicle damage thresholds are met. DOT sets time windows after the incident during which testing must occur.

DOT urine collections use a split-specimen process: the sample is divided into two bottles. If Bottle A tests non-negative, Bottle B is preserved for a retest at the employee’s request.

Under 49 CFR Part 40, a breath alcohol concentration of 0.04 or higher requires immediate removal from safety-sensitive duties. A result between 0.02 and 0.039 requires temporary removal and a follow-up test, but doesn’t trigger the full return-to-duty process. Medical marijuana isn’t a valid explanation for a positive DOT drug test result under federal regulation, regardless of state law.
