DOT Alcohol Testing Rules Employers Need to Know

Federal alcohol testing requirements are set by 49 CFR Part 40, which governs procedures across all DOT agency modes. Understanding the threshold rules and confirmation process helps employers move quickly and correctly when a test event occurs.

EBT Device & Technician Requirements

The evidential breath testing device used in a DOT-regulated test must be approved by the National Highway Traffic Safety Administration and may only be operated by a certified breath alcohol technician. We meet both requirements on every test we conduct.

What Constitutes a Failed Test

A result of 0.04 blood alcohol content or higher is a formal DOT alcohol test failure. Certain conduct also can produce an automatic failed result, regardless of BAC:

Refusal to take a breath alcohol test
Refusal to complete or sign the testing form
Refusal to provide adequate breath
Refusal to cooperate with any part of the testing process

A BAC reading between 0.02 and 0.039 doesn’t constitute a formal violation, but the employee must be removed from safety-sensitive duties for at least 24 hours.

Confirmation Test Protocol

When an initial screening returns a result of 0.02 BAC or higher, a confirmation test must follow using an EBT, administered no sooner than 15 minutes and no later than 30 minutes after the screening test. When DOT Alcohol Testing Is Required

DOT regulations require alcohol testing under six circumstances: pre-employment (at employer discretion for alcohol), random, post-accident, reasonable suspicion, return-to-duty, and follow-up. Timing rules are strict for post-accident testing: the test should be completed within 2 hours of a qualifying event, and if it isn’t completed within 8 hours, the employer must document why.
