Random Testing Rates by DOT Agency

Each of the six safety-sensitive agencies sets its own minimum random testing rates, reviewed annually based on industry-wide positive test data. The rates below reflect current published minimums, but employers should confirm current figures with their consortium/third-party administrator (C/TPA) or directly with the applicable agency each year.

After a Positive Result: the Federal Process

When an employee receives a positive DOT drug or alcohol test result, the employer must immediately remove that employee from all safety-sensitive functions. That removal isn’t discretionary. The employer must then refer the employee to a qualified Substance Abuse Professional (SAP) for evaluation and any required education or treatment.

Before the employee can return to safety-sensitive work, they must pass a return-to-duty test conducted under DOT protocols. From there, the SAP determines a follow-up testing schedule, typically one to five years of unannounced tests. FMCSA-regulated employers must also report drug and alcohol violations to the FMCSA Drug and Alcohol Clearinghouse within three business days. A written DOT drug and alcohol policy that communicates these consequences clearly to employees is a federal requirement and supports consistent handling when violations occur.

How the Random Selection Process Works

A compliant random selection process uses a scientifically valid method, typically a computer-generated draw, to select employees from the pool. Every covered employee performing safety-sensitive functions must remain in the pool and have an equal chance of selection each draw period; no employee can be excluded while actively performing those functions.

When an employee is selected, the Designated Employer Representative (DER) receives notification from the C/TPA and directs the employee to report for testing immediately. Advance notice or delays undermine the unannounced nature of random testing and can create compliance exposure. Employers must retain chain-of-custody forms, test results, and selection records to demonstrate compliance during a DOT audit or safety review. Most employers run selections quarterly, though the total annual testing rate must meet the applicable agency minimum by year-end.

DOT Audit Preparation & Your Random Program Records

During a DOT safety audit, examiners typically request pre-employment test records, proof of random pool enrollment, a complete list of covered employees, chain-of-custody documentation, and annual MIS reports.
