The Legal Tangle of Opioids in the Workplace

Know the Legal Landscape Before You Test

Employers are allowed to implement drug testing programs, but the how and when matter. Random testing, post-incident screening, and return-to-duty testing are all legal if documented and applied consistently. Where it gets tricky is when you test for opioids. Especially if an employee has a valid prescription.

Federal law protects workers from discrimination based on disability, which can include addiction or medically necessary pain management (National Center for Biotechnology Information [NCBI], 2017a). That’s why it’s essential to have a written policy, clear consent forms, and a medical review process in place before making employment decisions.

Finding the Balance Between Privacy and Safety

Privacy laws (like HIPAA) mean you can’t share results broadly, even if someone tests positive. But safety regulations give you the right to act if someone is impaired or poses a risk. Your best bet is to clearly define what “fit for duty” looks like and how testing fits into your safety program (NCBI, 2017a).
