DOT Alcohol Testing Procedures Under 49 CFR Part 40

For Federal Motor Carrier Safety Administration safety-sensitive drivers, alcohol testing follows the procedures established in 49 CFR Part 40. These federal rules address approved testing methods, the responsibilities of the Breath Alcohol Technician, and the distinction between screening and confirmation tests.

A Breath Alcohol Technician is trained to instruct and assist the employee during testing and operate an evidential breath testing device. The device measures alcohol concentration from a breath sample and produces a result used in the DOT testing process.

DOT procedures permit either saliva or breath testing for the initial alcohol screening. When breath is used, the device must be approved by the National Highway Traffic Safety Administration and included on its approved device list.

Confirmation Testing at 0.02 or Greater

A screening result below the federal threshold completes the procedure without a confirmation test. When the result is 0.02 or greater, a confirmation test follows and provides quantitative alcohol concentration data. Confirmation testing must use breath and an approved device.

Providing the Confirmation Sample

During confirmation testing, the Breath Alcohol Technician directs the employee to blow steadily and forcefully into the mouthpiece for at least six seconds or until the device indicates that it has received an adequate sample. The technician then shows the displayed result to the employee.

The 0.02 and 0.04 concentrations are defined points within DOT alcohol testing procedures. Employer actions following a result depend on the applicable DOT regulations and the employee’s role, so the testing record must be handled according to the governing program.
