The Federal Framework Behind DOT Testing

49 CFR Part 40 is the DOT-wide regulation governing how drug and alcohol tests are collected, conducted, and reported across all transportation modes. It sets the procedures your collection service must follow, and responsibility can’t be outsourced away. Even when you use an outside collection service, employers retain full responsibility for complying with 49 CFR Part 40 and Part 382.

FMCSA-regulated employers face an additional recordkeeping layer. Since January 6, 2020, those employers must report drug and alcohol program violations to the FMCSA Drug and Alcohol Clearinghouse and query it before a new hire performs any safety-sensitive function, and at least once annually for current employees. Staying current with Clearinghouse obligations is part of running a compliant program.
