When FMCSA Requires Testing After an Accident

Under 49 CFR 382.303, the Federal Motor Carrier Safety Administration requires drug and alcohol testing after certain accidents involving CDL drivers in safety-sensitive positions. The requirement depends on whether the accident caused a fatality, an injury requiring treatment away from the scene, or disabling damage that required a tow. A moving-violation citation also affects whether testing is required in nonfatal accidents.

Testing is required in these situations:

A Fatality Occurred: Drug and alcohol testing is required when an accident results in a death, regardless of whether the commercial driver receives a citation.
An Injury Required Treatment Away From the Scene: Testing is required when someone receives immediate medical treatment away from the scene and the commercial driver receives a moving-violation citation within the applicable regulatory period.
Disabling Damage Required a Tow: Testing is required when a vehicle must be transported away from the scene and the commercial driver receives a moving-violation citation within the applicable regulatory period.

If there’s no fatality and the driver doesn’t receive a qualifying citation, federal testing generally isn’t required under this rule. The presence of police at the scene doesn’t create a federal testing requirement by itself.

Federal Alcohol & Drug Testing Deadlines

The compliance clock starts when the accident occurs, not when the employer learns about it. For nonfatal accidents involving an injury or tow, the citation must be issued within eight hours to trigger alcohol testing and within 32 hours to trigger drug testing.

Employers must also track two collection deadlines:

Alcohol Testing: Breath alcohol testing should be attempted as soon as possible. If it isn’t completed within two hours, the employer must document the reason. Attempts must stop after eight hours, and an explanation for the missed deadline must remain on file.
Drug Testing: The required five-panel urine drug test must be completed within 32 hours. If the collection can’t be completed by then, the employer must stop further attempts and document why the deadline was missed.

A DOT drug collection follows chain-of-custody procedures that record who handled the specimen from collection through laboratory processing. Results are reviewed under Department of Transportation procedures, including review by a Medical Review Officer when applicable.

Records & Documentation After an Accident

Compliance doesn’t end when the collection is complete. Employers need records showing why testing was required, when each attempt occurred, when the test was completed, and why a deadline was missed when a collection couldn’t be performed. FMCSA auditors may request these materials when reviewing a carrier’s compliance file.
