South Carolina Workplace Drug Testing Considerations

The state generally doesn’t require private employers to conduct workplace screening unless a federal rule applies, including requirements for certain safety-sensitive transportation roles. South Carolina Code § 41-1-15 allows employers to establish workplace drug prevention programs with a written substance abuse policy and employee notice when the program begins or an employee is hired. The statute treats test results and related records as confidential communications.

The state’s workers’ compensation merit rating system includes a credit of at least five percent for an insured employer participating in a qualifying workplace drug or alcohol prevention program. Qualifying procedures require random sampling of all paid employees. Businesses receiving a state grant or contract of $50,000 or more must certify that they’ll implement and maintain a drug-free workplace program under the South Carolina Drug-Free Workplace Act.

Federal Procedures Under 49 CFR Part 40
