Nebraska Law & Workplace Drug Testing

Nebraska’s voluntary drug-free workplace framework, established under Nebraska Revised Statutes 48-1901 through 48-1910, gives employers a structure for designing and maintaining a compliant testing program. Following that framework can help keep your policies, procedures, and testing practices consistent with state law.

There’s also a direct connection to workers’ compensation liability. Under Nebraska Revised Statute 48-127, an employee isn’t entitled to workers’ compensation benefits for an injury caused by their own intoxication. A documented testing program can give you records that may support that defense if a workplace injury involves intoxication, but only when the program and its documentation are in order before an incident occurs.

Federal DOT Testing Requirements
