How DOT Alcohol Testing Works: The Regulatory Process

DOT alcohol testing follows a two-step process under 49 CFR Part 40. The first step is an initial screening test, which may use a saliva test or an evidential breath testing device (EBT). Saliva tests are permitted for the screening step only. If the screening result comes back at 0.02 breath alcohol concentration (BAC) or higher, a confirmation test on an EBT must follow.

The confirmation test must be conducted no sooner than 15 minutes and no later than 30 minutes after the screening. That window exists to rule out residual mouth alcohol from recent eating, drinking, or other factors. The confirmation test result, not the screening result, determines what regulatory actions are taken.

BAC Thresholds & Required Actions

Three result ranges carry different consequences for the employee and the employer:

Below 0.02 BAC: Negative result. No action required.
