When DOT Alcohol Testing May Be Required
Testing requirements depend on the transportation agency, the employee’s safety-sensitive role, and the circumstances surrounding the event. Although 49 CFR Part 40 establishes common procedures, agency-specific regulations determine who is covered and when testing applies.
Employers may need to prepare for these testing events:
- Random alcohol testing: Testing conducted through a compliant random selection program for covered employees.
- Post-accident DOT alcohol testing: Testing after an accident that meets the applicable agency’s criteria and timing requirements.
- Reasonable suspicion testing: Testing based on specific, contemporaneous observations made by a trained supervisor.
- Return-to-duty: Testing required before an employee who violated applicable rules can resume safety-sensitive functions.
- Follow-up: Unannounced testing performed according to the schedule established through the return-to-duty process.
Requirements vary among FMCSA, FAA, FTA, PHMSA, USCG, and FRA. Employers should follow the rules for their specific mode of transportation rather than assume one agency’s requirements apply to every workforce.
What to Expect During a DOT Alcohol Test
The employee provides positive identification, receives an explanation of the procedure, and completes the required alcohol testing form with the technician. Our certified breath alcohol technician then conducts the test using the required procedures and documentation.
A screening test may be followed by a confirmation test when required by the initial result. Confirmation testing uses an evidential breath testing device, often called an EBT. The device must meet federal equipment requirements, including standards associated with the National Highway Traffic Safety Administration.
We handle reporting test results as part of our testing support. A refusal or a result at or above an applicable regulatory threshold can trigger employer obligations, but the required response depends on the governing agency and the circumstances.
Support for Your DOT Compliance Program
A functioning DOT compliance program may involve written policies, trained supervisors, random testing coordination, recordkeeping, and defined procedures after a violation. We help businesses organize these responsibilities through policy creation and implementation and ongoing program management.
Mobile DOT alcohol testing can serve a worksite, fleet operation, or time-sensitive post-accident response when an off-site collection isn’t practical. To evaluate the appropriate arrangement, employers should be ready to discuss the location, workforce, and triggering event.
