Random: CDL drivers must belong to a random testing pool. FMCSA’s current annual rate is 50% of the average driver count for drugs and 10% for alcohol.
Return-to-duty: Before resuming safety-sensitive functions after a violation, an employee must complete the return-to-duty process with a DOT-qualified Substance Abuse Professional (SAP) and pass a verified test.
Follow-up: A minimum of six unannounced follow-up tests are required in the first year after return to duty, with frequency and duration set by the Substance Abuse Professional.

The FMCSA Drug & Alcohol Clearinghouse

The FMCSA Drug and Alcohol Clearinghouse is a centralized federal database where employers must report drug and alcohol program violations and conduct queries on prospective and current CDL drivers. A full pre-employment query is required before a new driver performs safety-sensitive functions, and annual limited queries must be run for every active CDL driver at least once every 12 months.

Clearinghouse II took effect November 18, 2024. Under this update, state driver licensing agencies are now required to downgrade a driver’s CDL when an unresolved drug or alcohol violation appears in the Clearinghouse. Drivers in a prohibited status must complete the return-to-duty process with a Substance Abuse Professional before they’re permitted to operate a commercial motor vehicle again. Employers who aren’t conducting required queries on schedule face enforcement exposure independent of their testing program.

Post-Accident, Reasonable Suspicion, & Return-to-Duty Testing

Post-accident testing is required after any accident involving a fatality, and also when a driver receives a citation following an accident that results in disabling vehicle damage or requires immediate medical treatment, depending on the applicable DOT agency’s criteria.

Reasonable suspicion testing must be based on specific, documented observations of the driver’s appearance, behavior, speech, or body odors, made by a trained supervisor. The driver shouldn’t be permitted to drive to the testing facility unaccompanied.

Return-to-duty tests must be conducted under direct observation. Once a driver passes and the Substance Abuse Professional clears them, follow-up testing continues for a minimum of 12 months and up to 60 months, with at least six unannounced tests required in the first year.

DOT Testing for FAA, FRA, FTA, PHMSA, & USCG Employers
