Who Must Enroll in a DOT Random Testing Program

How the DOT Random Selection Process Works

Random selections are typically made on a quarterly basis using a computer-generated, scientifically valid method. When an employee is selected, the employer’s DER receives notification from the C/TPA and must direct that employee to report for testing immediately. The process isn’t optional, and the timing isn’t negotiable.

At the Collection Site

Ignoring a selection notification is treated as a refusal to test, which carries the same regulatory consequences as a confirmed positive result. At the collection site, the employee presents a government-issued photo ID. The collector documents everything on a Federal Custody and Control Form (CCF), and the specimen is collected following the standard urine collection procedure outlined in 49 CFR Part 40. Confirmed positive results are reviewed by a Medical Review Officer (MRO) before the employer is notified. A confirmed positive requires the employer to immediately remove the employee from safety-sensitive duties. The employee must then complete the DOT return-to-duty process with a Substance Abuse Professional (SAP) before resuming safety-sensitive work.

What New DOT-Regulated Companies Need to Know

New carriers don’t get a grace period on testing compliance. Before a safety-sensitive employee may operate a covered commercial motor vehicle, a negative pre-employment DOT drug test result must be on file. Owner-operators must complete a pre-employment test and enroll in a consortium before beginning operations.

FMCSA may conduct a safety audit within the first 12 months of operation, during which inspectors verify that a compliant drug and alcohol testing program is in place. Failing that review can result in an automatic failure, and carriers that don’t satisfactorily address deficiencies risk revocation of their DOT registration.
