When DOT Post-Accident Testing Is Required
Not every workplace accident triggers a federal testing obligation. Under 49 CFR Part 382.303, the rules are specific about which accidents require testing, and testing outside those defined circumstances isn’t authorized under the regulation. Your Designated Employer Representative (DER) needs to know these conditions before getting on the phone.
DOT post-accident testing is required if the accident involved a fatality. For non-fatal accidents, testing is required when the driver received a citation for a moving traffic violation and either of the following also applies:
- Any individual involved required immediate medical treatment away from the scene
- Any vehicle involved required a tow from the scene
For fatalities, fault doesn’t factor into the determination. For injury and tow-away scenarios, the citation requirement applies whether or not the driver was at fault.
Testing Deadlines Under FMCSA Rules
Federal regulations set firm windows for completing post-accident testing. Missing either window without documentation is a compliance failure that FMCSA auditors look for specifically.
Alcohol Testing Timeline
Alcohol testing must be completed within 8 hours after the incident. If that window expires before testing can be completed, the employer must stop attempting and document the reason in writing. During the entire post-accident window, the driver is legally prohibited from consuming any alcohol prior to the alcohol test.
Drug Testing Timeline
Drug testing must be completed within 32 hours. If the window expires, a documented explanation of why testing wasn’t completed must be placed on file. An undocumented missed window is treated as a compliance failure during an FMCSA audit, not simply an administrative oversight.
When Law Enforcement Testing Is Involved
Results from law enforcement breath testing at the accident scene can satisfy the DOT post-accident testing requirement, provided those tests conform to applicable requirements and the employer can obtain the results. When law enforcement testing isn’t available or results can’t be obtained, a separate, compliant DOT collection is required.
