Under 49 CFR 382.303, federal testing requirements depend on the outcome of the accident and, in some cases, whether the commercial driver receives a moving-violation citation. The employer is responsible for determining whether the incident meets the applicable criteria. This overview provides general information, not legal advice.
Post-accident testing may be required following:
- A fatality: Each surviving commercial driver who was performing safety-sensitive functions with respect to the vehicle must be tested.
- An injury with a citation: Testing applies when someone receives immediate medical treatment away from the scene and the commercial driver receives a citation for a moving violation arising from the accident.
- Disabling damage with a citation: Testing applies when a vehicle must be transported from the scene by a tow truck or another motor vehicle and the commercial driver receives a citation for a moving violation arising from the accident.
For injury and disabling-damage events, the citation must be issued within eight hours for alcohol testing or 32 hours for controlled-substance testing.
Federal Testing Time Frames
