What Federal Regulations Require in a DOT Drug & Alcohol Policy

A DOT drug and alcohol policy isn’t just a statement of intent. Federal rules specify what the document must contain. At minimum, the policy must name the individual responsible for answering driver questions about the program materials, identify which categories of drivers are subject to testing, and describe the safety-sensitive functions and time periods during which drivers must comply.

The policy must also spell out prohibited conduct and the thresholds that constitute a positive test. Under federal rules, an alcohol concentration of 0.04 or higher is a violation, as is a verified positive, adulterated, or substituted drug test result. Employers must provide the policy to every covered driver, including new hires, employees transferring into safety-sensitive roles, owner-operators, staffing service drivers, and contract workers. Each driver must sign a statement certifying they received it.
