DOT Alcohol Testing Regulations: EBT Requirements & Post-Violation Steps

49 CFR Part 40 is the federal regulation that governs how alcohol and drug tests are conducted across DOT-regulated modes. It applies to employers under FMCSA, FAA, FTA, PHMSA, and FRA. Note that the USCG, now under the Department of Homeland Security, incorporates Part 40 for drug testing purposes but operates its alcohol testing program under separate agency rules. Part 40 sets the procedural standards that make a test legally defensible, and every step, from device selection to result documentation, must follow those procedures.

The evidential breath testing device (EBT) must appear on the National Highway Traffic Safety Administration’s Conforming Products List and may only be operated by a certified breath alcohol technician. No other device type satisfies DOT alcohol testing requirements. A confirmed BAC of 0.04 blood alcohol content or above constitutes a violation and requires immediate removal from safety-sensitive duties.

As of November 18, 2024, state driver licensing agencies are required under Clearinghouse II to downgrade a CDL driver’s commercial driving privileges when that driver has an unresolved drug or alcohol violation recorded in the FMCSA Drug and Alcohol Clearinghouse. Employers must ensure violations are reported accurately and promptly, and that the return-to-duty process is documented in the Clearinghouse when completed.
