Understanding DOT Drug & Alcohol Testing Regulations

Two layers of federal regulation govern DOT drug and alcohol testing. The first is 49 CFR Part 40, the DOT-wide rule that sets how testing must be conducted, how chain-of-custody must be maintained, and how results must be reported. It applies to all DOT agencies and all regulated employers. The second layer is each agency’s own rule, which defines which employees must be tested and under what circumstances. The FMCSA Clearinghouse & the Clearinghouse II Update
