49 CFR Part 40 and What It Requires of Employers

49 CFR Part 40 is the DOT rule that defines exactly how workplace drug and alcohol testing must be conducted across the federally regulated transportation industry. It covers everything from chain-of-custody procedures and specimen collection to MRO review and result reporting. Employers don’t get to choose their own procedures. Part 40 sets the standard, and the DER is responsible for helping make sure the organization follows it.

Supervisor Training for CDL Employers

FMCSA-regulated employers have an additional obligation under 49 CFR 382.603: supervisors of CDL drivers must complete at least 60 minutes of training on alcohol misuse and 60 minutes on controlled substance use before they can make a reasonable suspicion testing referral. Reasonable suspicion testing, meaning a test triggered by a supervisor’s documented observations of an employee’s behavior or appearance, is only defensible when that training is already on record.
